They determine the rights and obligations of the parties in the context of online sales of products offered by Eureka Shop and apply to all transactions made between this company and the buyer.

1 - PURPOSE

These GTC govern the sales of flowers, plants, bouquets, arrangements, dried flowers, accessories, and containers related to funeral art offered by Ereka Fleuriste of Eureka Shop company, whose registered office is in Marrakech

2 - GENERAL PURCHASE CONDITIONS

The buyer acknowledges having read the GTC at the time of purchase and declares to accept them without reservation. Any order implies the buyer's full adherence to these conditions.

3 - PRODUCTS

Eureka Shop commits to respecting the conformity between the product presented on the site and the one that is delivered. However, due to the quality of the product (cut flowers) or depending on the availability of plants in the same range, Eureka Shop reserves the right to replace a product with another while respecting as closely as possible the visual of the chosen bouquet or arrangement.

4 - ORDERS

They are placed directly on the site.

They are only final when they have been confirmed by the payment made by the buyer.

The recorded confirmation will serve as proof of the transaction.

Any order placed before 6 PM can be delivered from the next day within the defined delivery hours, between 9:30 AM and 6 PM. Any order placed after 7 PM will be delivered from the day after tomorrow.

After shipping, any modification or cancellation of the order by the buyer cannot be taken into account and the amount of the product will not be refunded.

In case of stock shortage, Eureka Shop will contact the buyer to agree on a similar product in size and quality to the one ordered.

5 - PRICES

Product prices are indicated in DHS including VAT. Delivery charges are additional. Their amount is indicated on the order summary. Thank you cards are offered.

6 - PAYMENT METHODS

Payment is required at the time of order.

The customer can make the payment:
- either by Credit Card online
- or by PayPal

- or in cash on site

The customer authorizes the seller to debit their card for the amount related to the indicated price. The customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it. The purchase invoice can be downloaded from the buyer's customer account at the end of the purchase process.

7 - ORDER CANCELLATION

In case of impossibility for the seller to debit the payment card, the sale is immediately resolved by right and the order cancelled.

In accordance with legal provisions, the right of withdrawal cannot be exercised for products made to order and therefore does not apply to orders registered by Eureka Shop.

8 - DELIVERY

Products are delivered to the address indicated by the customer during the order within the deadlines indicated by the seller.

The customer is informed of the effective delivery by email or written telephone message (WhatsApp) or SMS.

Eureka Shop cannot be held responsible for a delivery delay due to a cause beyond its control (fortuitous event or force majeure, bad weather, disaster, road accident) that would prevent the execution of its obligations.

If there is an impossibility to deliver the product on time due to an error by the buyer (incorrect or incomplete address, insufficient information and details), Eureka Shop cannot be held responsible and will not make any refund.

As deliveries are mainly made to public places, no delivery certificate signed by a third party can be provided.

9 - RESPONSIBILITIES AND WARRANTIES

The buyer's personal data is treated with strict confidentiality by Eureka Shop.

10 - DISPUTE RESOLUTION

All clauses appearing in these GTC as well as all purchase and sale operations referred to therein are subject to Moroccan law.
